Avoid Some Common Divorce Mistakes – Transcript
[00:00] So I wanted to take a minute and share some basic divorce mistakes that should be avoided when getting divorced or contemplating getting divorced. The first premise to be aware of is that everything that you do financially and everything that you do with your time, it’s going to be scrutinized by the court. Meaning you’re going to live your life under a microscope.
[00:25] If you’re going to the bar at 10 o’clock at night, leaving the children home alone, asleep as you go drink, it’s going to be discovered and that’s going to be a problem. If you use drugs and you’re arrested for using or selling drugs, that’s going to be an issue for future custody determinations and things like that. So, basic things to do or the basic idea here is just understand that your life is going to be under a microscope.
[00:58] Another divorce mistake is that you can’t move large sums of money around. You can’t gift or destroy property. Everything that you do is going to be discovered and you’re going to have to answer for those things. So be conscious of that. Another thing I counsel my clients not to do is, if you have firearms at the house, make sure that those firearms are secure.
[01:21] One of the things that I hear about a lot is – there are guns in the house, they’re not secured and the children aren’t safe. If you don’t have a gun safe, make sure that you get one so that all firearms are locked up, so it’s not an issue for future arguments down the road. Be careful with where you go. Understand that there might be private investigators trailing you or watching the things that you do and where you go.
[01:51] So just be aware. Another thing that I counsel my clients to do is be conscious of what you post on your social media. Understand that again, your social media is free game and the courts will definitely be apprised of your social media presence. So if you’ve got lots and lots of pictures of you drinking or getting wasted as it were or talking about you know how much you hate or dislike your spouse or significant other, be conscious that the things that you say and the pictures that you post will all be viewed by the court. You’re going to have to explain what they mean, why you said what you did and those things may have significant ramifications on your divorce or custodial case.
